It is submitted by the learned counsel for the petitioner that the proceedings in Special Civil Suit No.690 of 2005 as filed by the respondent No.1, are pending without any justifiable progress. The copy of the roznama is filed on record to indicate that even after the suit was re-registered as Regular Civil Suit No.200861 of 2012, the same is pending without much progress. The petitioner-defendant No.15 therefore seeks expeditious consideration of the said suit. It is stated that an order of temporary injunction is operating against the petitioner.

In these facts, the petitioner is at liberty to make an application for expeditious disposal of the aforesaid suit pointing out these contingencies to the Trial Court. The Trial Court shall consider such application in accordance with law. In case the petitioner is aggrieved by that order, it is at liberty to challenge the same in accordance with law.
