Apprehending arrest in connection with crime registered by the non-applicant for the offences punishable under Sections 354, 376(2)(n) and 506 of the Indian Penal Code, the applicant has sought pre-arrest bail. The complaint is lodged by Ku.Yashika Jivtani (aged about 20 years) on 1st April, 2017 that when she was attending classes conducted by the applicant at Creative
2 aba290.17 Academy in 2016, the applicant who was delivering lectures at the classes stopped her after the class was over, misbehaved with her and then sexually exploited her threatening to make public the video clip recorded by him. The application is opposed on the ground that the crime is serious and the cellphone of the applicant with the video clip / recording is to be seized.
The applicant aged about 30 years claims to be a teacher and has stated that he is not involved in any other crime/ offence.
This Court has granted interim protection to the applicant by order passed on 27th April, 2017 imposing conditions on the applicant. It is not the complaint of the Investigating Agency that the applicant has not complied with the conditions imposed by this Court and has not co-operated with the Investigating Agency.
Considering the facts of the case, the order passed by this Court on 27th April, 2017, granting protection to the applicant, is confirmed.
The application is allowed accordingly.
