Heard.

The applicant is arrested on 01.07.2016 in crime registered against him and another accused for the offence punishable under Section 302 read with Section 34 of the Indian Penal Code. According to the Investigating Agency, the applicant and co-accused Shivam assaulted deceased as the applicant suspected that there was love affair between deceased and applicant's sister. Both the accused are real brothers. Co-accused Shivam is granted bail by this Court by the order passed in Criminal Application (BA) No.1018 of 2016 on 8th June, 2017.

The investigation is complete and charge-sheet is filed. The non-applicant has not been able to show that the custody of the applicant is required for further investigation. In the facts of the case, following order is passed:

2 ba534.17 The applicant having been arrested in Crime No.391 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond of Rs.50,000/- and on furnishing two solvent sureties in the like amount. The applicant shall attend the proceedings of trial before the Sessions Court on every date unless granted exemption by the Sessions Court.
