Heard learned counsel for the petitioner.
Learned counsel for the petitioners states that the application for grant of bail was filed on 26th September, 2014 and thereafter on 30th January, 2015, prosecution filed its reply/say. He then submits that despite lapse of several months and in any case approximately ten months, the concerned Additional Sessions Judge has not decided the petitioners' application one way or the other. He further submitted that majority of the accused have been released either by the Court of Additional Sessions Judge at Mangrulpir, or by this Court.
Upon hearing learned counsel for the rival parties, I think, the Additional Sessions Judge,
Mangrulpir, should be asked to decide the application filed by the petitioners. That being so, I make the following order:- Criminal Writ Petition No. 553 of 2015 is disposed of with a direction to the Additional Sessions Judge, Mangrulpir, to decide the bail application pending before him on or before 24th July, 2015.
Hamdast Writ is allowed for being presented before the Trial Court.
