DATE : 6 th APRIL, 2021 Hearing was conducted through Video Conferencing and the learned Counsel agreed that the audio and visual quality was proper.

Heard learned Counsel Dr. R.S. Sirpurkar for the applicant-appellant and learned A.G.P. Shri M.A. Kadu for the respondents.

The appeal is already disposed of. The respondents have deposited Rs.1,25,25,858/- before the District Court (8th Jt. Civil Judge Senior Division). It is submitted that the amount is unnecessarily deposited before the District Court, even though no proceedings are pending there. Considering the age and COVID situation, the appellant is apprehending to attend the District Court premises. As against this, he is ready to attend this Court for the purpose of personal identification.

caf.1479.20 2/2 The learned A.G.P. has submitted to pass appropriate orders. Hence the order :

i.

The Office is directed to accept the personal identification of the appellant and to complete the office procedure.

ii.

The appellant is directed to furnish the bank details.

iii. After completion of the office procedure, the Office is directed to inform the District Court that the procedure has been complied with and also inform the District Court to released the amount.

iv. After completion of the same, the District Court, Nagpur is directed to transfer the amount along with the accrued interest in the Bank Account of the appellant.

v.

The application is disposed of accordingly.
