ATE : FEBRUARY 05, 2025 1) Heard Mr.Shende, learned counsel for the petitioner seeks implementation of Government Resolution dated 09/07/1987 Clause (2) (page21B) under the terms of which the petitioner who is presently teaching 6th to 8th standard with respondent No.3 institution claims entitled to be upgraded to teach 9th and 10th standards. The plea of the petitioner has been rejected on the ground that there is senior teacher available, and unless she is accommodated for that purpose, the petitioner would not be entitled.

2) Clause (2) of the above G.R. indicates that any such upgradation has to be done in terms of seniority. Admittedly, when there is senior teacher Ku.Atram, who is teaching 6th to 8th standard with the said school, her claim would have preference over the petitioner. Though Mr.Shende states that there are three vacancies available in the High School department, 9th and 10th standard, however, Mr.Patil, learned counsel refutes that position. In that view of the matter, we are not inclined to entertain the petition, the same is dismissed. No costs.
