By this petition, the petitioner has sought a direction to the respondents to pay the subsistence allowance. The concerned respondent has filed the reply and has stated that the subsistence allowance is paid to the petitioner. The learned counsel for the petitioner has disputed the position. Since there is a dispute in regard to the payment of subsistence allowance to the petitioner and the said issue cannot be decided, in exercise of the writ jurisdiction, the learned counsel for the petitioner states that he will agitate this issue in the matter, if filed by the petitioner, against the order of his termination. The learned counsel seeks permission to withdraw the writ petition in this background. Permission to withdraw the writ petition is granted. The writ petition is disposed of as withdrawn. The point in regard to the payment of subsistence allowance is kept open. The respondent Nos.2 and 3 are permitted to withdraw the amount deposited in this Court.
