The appellant to serve the respondent no.2-Driver, who was working with the appellant, within a period of four weeks from today, failing which the appeal shall stands dismissed against the respondent no.2.

The appellant to file paper book within six months from today, failing which the appeal shall stand dismissed without further reference to the Court.

The applicant/respondent no.1 is permitted to withdraw 70% of the amount deposited in this Court upon furnishing an undertaking that if in case the appeal is allowed he shall make good the loss within a period of twelve weeks from the date of decision in the appeal along with interest at the rate of 7% per annum. The civil application is allowed in aforesaid terms and disposed of.
