Heard Shri Khati, learned counsel for the petitioner and Ms. Khan, learned AGP for respondent No. 2. The petitioner, who has entered the service before coming into force of Maharashtra Scheduled Castes, Scheduled Tribes, De-notified Tribes (Vimukta Jatis), Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of Issuance & Verification of) Caste Certificates Act, (Act No. 23 of 2001), states that the caste claim is still under scrutiny of Respondent No. 1. Shri Deshpande, learned counsel for respondent No. 1 states that the efforts are being made to dispose of the caste claim within the reasonable time.
This Court has protected the employment of the petitioner on 24.07.2013.
In this situation, we direct the petitioner to appear before Respondent No. 1 - Committee on 19.05.2015 and to abide by its further instructions in the matter. The
2503wp3885.13 Committee shall complete the verification in accordance with law within one year thereof. The interim orders passed by this Court to continue and shall be subject to said adjudication.
The request of Shri Khati, learned counsel for protection of services of the petitioner shall be considered thereafter, if the occasion therefor arises.
Writ Petition is thus partly allowed and disposed of. However, there shall be no order as to costs. JUDGE JUDGE *GS.
