Heard learned Counsel for the parties.

The petitioner claims to belong to Other Backward Classes (OBC) category. She was issued caste certificate on the strength of her father's documents. In 2013-14, she was admitted at the Respondent No.3 College in Bachelor of Engineering course from OBC category. It appears that the caste certificate of the Petitioner was not forwarded for further verification. In the meanwhile, the Petitioner completed her education. The Petitioner prays that the Respondent Nos.2 and 3 be directed to issue marks-sheet of the course completed by her by treating her admission from Open category. In the affidavit-in-reply filed on behalf of the Respondent No.3, it has been stated that unless an amount of ₹ 2,05,980/- is paid by the Petitioner, she cannot be treated as a candidate from Open category. The learned Counsel appearing for Respondent no.2 submits that on making the entire payment of fees as applicable to a candidate from the Open category, the provisional marks-sheet and

W.P.4555.22 provisional degree would be issued to the Petitioner based on her performance.

The learned Counsel for the Petitioner submits that the aforesaid amount would be paid at the Respondent No.3-College within a period of two months, i.e. till the end of February, 2023. The statement is accepted. On making such payment, the Respondent Nos.2 and 3 shall issue marks-sheet and provisional degree of the course to the Petitioner.
