Apprehending the arrest at the hands of police in connection with Crime No. 225/2025 registered with Police Station Akot, Gramin, District Akola for the offence punishable under Sections 118(1), 352 of the Bhartiya Nyaya Sanhita, 2023, the applicant approached this Court for grant of pre-arrest bail.

The crime is registered on the basis of a report lodged by Ravindra Namdevrao Dhande on an allegation that on 12/04/2025, at about 5.00 p.m., he was sitting in front of house of Govardhan Dhande at the relevant time, the applicant came and assaulted by means of a stick, due to which he sustained the injuries. On the basis of the said report, police have registered the crime against the present applicant.

Heard learned counsel for the applicant, who submitted that the stick is already recovered and the injured is also discharged from the hospital. As far as the custodial
interrogation of the present applicant is concerned, which is not required. The informant is not having any apprehension as to the death. For all of the above reasons, the applicant be released on anticipatory bail.

Learned APP strongly opposed the said application on the ground that the informant/injured had undergone the surgery due to the assault, though he is discharged from the hospital. Considering the gravity of the offence, the prayer for grant of anticipatory bail deserves to be rejected. 5.
On hearing both sides and on perusal of the recitals of the FIR and the investigation papers, it reveals that the stick is already recovered. The injury certificate is on record, which shows the trauma. The treatment papers also disclose that the injured has undergone the surgery. However, now injured is already discharged from the hospital. As far as the custodial interrogation is concerned, which is not required, in view of that, I proceed to pass the following order. a] Criminal application is allowed.
b] The applicant - Vishal Rajendra Dhande, shall be released on bail in connection with Crime No. 225/2025 registered with Police Station Akot, Gramin, District Akola for the offence punishable under Sections 118(1), 352 of the Bhartiya Nyaya Sanhita, 2023, on executing P.R. Bond of Rs. 25,000/- with one solvent surety in the like amount.
c] The applicant shall not enter into the vicinity of village Manchanpur, Post Sawara, TalukaAkot, District Akola, till culmination of the trial.
d] The applicant shall not induce, threat or promise any witnesses who are acquainted with the facts of the present case.
e] The applicant shall furnish his detail address along with the address proof wherein he is intending to reside after he is released on bail.
f] The applicant shall attend the proceedings before the trial Court without seeking any exemption unless there are exceptional circumstances.
Criminal application is disposed of.
