Shri A.D. Sonak, A.G.P. for the respondent No.1 and Shri M.V. Samarth, Advocate for the respondent No.2 have taken objection to the locus of the Secretary to file the petition on behalf of the Society. The petition does not contain any averment regarding resolution of the Society authorizing the Secretary to raise such challenge.

In view of the objection, Shri A.M. Ghare, Advocate for the petitioner seeks permission to withdraw the writ petition with liberty to file fresh petition. The petition is disposed accordingly with liberty as prayed for.
