Heard.

The applicant, aged about 19 years, is arrested in crime registered against him for the offences punishable under Sections 363, 376(D) read with Section 34 of the Indian Penal Code and Sections 3, 4 and 6 of the Protection of Children from Sexual Offences Act, 2012. According to the Investigating Agency the victim, aged about 17 years, was working in the jewelery shop owned by co-accused Manoj Bhagat, that Manoj Bhagat had sought permission from the mother of the victim to take the victim to Bhopal for some work, however, subsequently Manoj Bhagat took her to MLA Hostel, Nagpur and committed crime and then the present applicant also committed crime, as alleged in the complaint. Though the application is opposed on the ground that there is material against the applicant showing his involvement in the crime and the crime is of serious nature, the non-applicant has not been able to point out that the custody of the applicant is required for further investigation.

2 ba535.17 Considering th nature of the accusations against the applicant and the facts of the case, following order is passed :

The applicant having been arrested in Crime No.217/2017, registered by the non-applicant, he be released on bail on executing P.R. Bond for Rs.Twenty Thousand and on furnishing one solvent surety in the like amount. The application is allowed in the above terms. CRI.APPLN.(APPP) NO.968/2017 In view of disposal of the bail application, the application praying for grant of time to file certified copy of FIR, Order etc. does not survive, hence, it is disposed of.
