Heard learned counsel for the applicant and learned APP for the respondent/State.
On going through the case diary, I find that none of the witnesses has taken name of this applicant in a specific manner. Reply of the prosecution states that this applicant was one of the persons who assaulted the deceased. However, the learned APP could not show to me statement of any witness attributing any particular role to this applicant. This applicant, as submitted by learned APP, has been identified in the test identification parade by the complainant. But, fact remains that nobody is willing to attribute any specific role to this applicant. The reply of the prosecution is absolutely silent on this aspect of the case and nothing could be shown to me by the learned APP regarding what this applicant did on the fateful day. The applicant is in jail since 20.01.2016. Charge-sheet has also been
filed. In the circumstances, I am of the view that the applicant deserves to be released on bail. Hence the order. Application is allowed and it is directed that the applicant shall be released on bail on his furnishing a P.R. Bond of Rs.20,000/- together with one solvent surety in like sum on conditions that the applicant shall regularly attend the dates fixed by the Court, shall co-operate with the trial Court in expeditious disposal of the case against him and shall not tamper with the prosecution witnesses in any manner.
