(2) Shri S.S. Shingane, learned counsel for petitioner submits that by this writ petition the petitioner is challenging the order dated 03.02.2020 passed by the learned District Judge-1, Malkarpur, District Buldana in M.J.C. No. 6 of 2014, whereby the learned Judge dismissed the application for condonation of delay in preferring the regular civil appeal before the said Court. He submits that since application for condonation of delay is rejected consequently the appeal is also stands dismissed. Therefore, he submits that he wish to withdraw this writ petition with liberty to the petitioner to file second appeal in this matter. (3) The writ petition is disposed of as withdrawn with liberty to the petitioner to file second appeal as prayed for. No costs.
