The applicant has filed this application to seek transfer of the proceedings i.e. Marriage Petition No.35/2024 pending before the 2nd Joint Civil Judge, Senior Division, Wardha to Family Court No.2, Nagpur. 2.

The learned Counsel for the applicant has stated that the marriage of the applicant and the non-applicant was solemnized on 17.08.2022. Due to matrimonial dispute, the applicant is staying with her mother at Nagpur since 25.07.2023. The applicant is poor lady and doing household work as a maid at Nagpur. She cannot afford the litigation cost. She is appearing before this Court through Legal Aid. It is inconvenient and not possible for her to bear the traveling charges to attend the litigation at Wardha, hence, filed this application to transfer the litigation which is pending before the 2nd Joint Civil Judge, Senior Division, Wardha to Family Court No.2, Nagpur. 3.

The non-applicant is duly served, but failed to appear in this matter.

Considering the financial condition of the

2 20.mca.465.24 applicant, as she is working as a maid and she could not bear the litigation cost, the application is allowed. 5.

The Marriage Petition No.35/2024 pending before the 2nd Joint Civil Judge, Senior Division, Wardha is hereby transferred to the Family Court No.2, Nagpur. 6.

There shall be no order as to costs.

The professional fees of the appointed Counsel for the applicant be paid as per Rules.
