Ms S.S.Jachak, Assistant Government Pleader for respondent no.1. CORAM :- A.S.CHANDURKAR AND M. W. CHANDWANI, JJ. DATE :- 14th MARCH, 2023 The petitioner has filed Pursis dated 24.02.2023 alongwith an acknowledgment of the copy of writ petition being served in the Office of the Municipal Council.

Accepting the statements made in the pursis, we have considered the grievance of the petitioner.

According to the petitioner, it was allotted work of supplying skilled and unskilled labourers to Nagar Panchayat, Malegaon. The work order in that regard was issued to the petitioner on 26.09.2018. It is the case of the petitioner that the said work was satisfactorily completed pursuant to which the petitioner has been issued an experience certificate dated 29.08.2019. The petitioner seeks payment of amounts due towards satisfactory completion of the work order. In that regard the petitioner has issued various communications to the Chief Officer to release its outstanding payment. In these facts, the following order would serve ends of justice: (i) The petitioner through its authorised representative shall appear before the Chief Officer, Municipal Council, Malegaon with all necessary documents on 27.03.2023.

942-wp-4446-21.odt 2 (ii) The Chief Officer shall consider the claim made by the petitioner pursuant to issuance of the work order dated 26.09.2018 as well as the experience certificate dated 29.08.2019 issued by the Municipal Council.

(iii) Based on such consideration, the Chief Officer shall take further steps in the matter and if the petitioner is found entitled to any amount under the aforesaid work order, the same shall be released in favour of the petitioner in accordance with law.
