The petitioner claims fitment in the proper scale w.e.f. 1.4.1980 and thereafter, from 1.4.1986. The petition has been filed almost after 12 years thereafter i.e. after 29.6.1998 after superannuation.

The notice sent to the petitioner for engagement of another Counsel has been received back unserved. Mr.A.M.Deshpande, learned A.G.P. appears on behalf of respondent nos. 4 and 5.

In the situation, we dismiss the present Writ Petition for want of prosecution. Rule is discharged. No costs.
