DATE : 02.09.2016 By this writ petition, the petitioner challenges the notice asking the petitioner to show cause as to why he should not be dismissed from service.

Shri Wankhede, the learned Counsel for the respondent states that the issue involved in this case was also involved in Writ Petition No.1066/2016 and after hearing the parties, by the order, dated 26.4.2016, the writ petition was dismissed. It is stated that the petitioner was permitted to show cause to the notice within a period of fifteen days from the date of the order. It is stated that since Writ Petition No.1066/2016 is dismissed on merits, by the order dated 26.4.2016 and since the issue involved in both the writ petitions is identical, this writ petition is also liable to be dismissed.

Shri Jagdale, the learned Counsel for the petitioner admits that the issue involved in both the writ petitions is identical and by the order, dated 26.4.2016, Writ Petition No.1066/2016 was dismissed.

Hence, for the reasons recorded in the order, dated 26.4.2016 in Writ Petition No.1066/2016, we dismiss this writ petition with no order as to costs. The petitioner is permitted to file a reply to the show-cause-notice within fifteen days, if so desired.
