This is an application filed by the petitioner/Management for recalling the order dated 31/01/2022, passed by this Court directing the petitioner/Management to deposit the entire back wages with this Court.

Learned Advocate for the petitioners states that the said order was passed because the record of enquiry was not produced by the petitioners. The order dated 31/01/2022 does not indicate that this was the reason for directing the petitioners to deposit the back wages. The matter was thereafter listed on 11/02/2022. Perusal of the order dated 11/02/2022 would demonstrate that this Court has recorded that the matter was substantially heard on 31/01/2022 and considering the facts of the case, the order of depositing the

The contention raised by the learned Advocate for the petitioners in the application for recalling of order dated 31/01/2022 is contrary to the contents of the order dated 31/01/2022 and 11/02/2022. The civil application is, therefore, rejected.

At this stage, Mr. Dhabe, learned Advocate for the petitioners states that the entire amount of back wages up to 31/01/2022 will be around Rs.50,00,000/- to Rs.60,00,000/- and it will be virtually impossible for the Management to deposit the said amount.

The petitioners are directed to deposit the amount in four equal installments. Each installment shall be deposited on before 30th of every calendar month. The first installment shall be deposited on 30/09/2025, following by next installment which would be deposited on or before 30/10/2025, 30/11/2025 and 30/12/2025.

Mr. Dhabe, learned Advocate for the petitioners states that the amount is not yet crystallized. 7.
The petitioner/Management shall deposit the amount of back wages as per the last drawn salary of the deceased respondent No.1 (employee).
