Heard.
The original plaintiff has challenged the orders passed by the trial Court refusing to condone delay in filing the application for bringing legal representatives of defendant No.1 on record and consequently, rejecting the application seeking permission to bring legal representatives of defendant No.1 on record. In this petition, the proposed legal representatives of defendant No.1 are not impleaded. Hence, in my view, it would not be proper to consider the grievance of the petitioner / original plaintiff at the back of the proposed legal representatives of defendant No.1. Hence, writ petition is dismissed with liberty to the petitioner to file proper petition, if so advised. No costs.
JUDGE Tambaskar.
