By this criminal writ petition, the petitioner challenges the order of the D.I.G. (Prisons), Nagpur, dated 04.02.2017 rejecting the application of the petitioner for grant of furlough leave.

Though we find that the impugned order does not suffer from any infirmity, the learned Additional Public Prosecutor fairly states that during the pendency of the writ petition, the appeal filed by the petitioner against the judgment of his conviction was allowed and the petitioner is released from the confinement. It is stated that in view of the subsequent development, the grievance of the petitioner would not survive.

In view of the statements recorded hereinabove, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
