This letters patent appeal is preferred by the management questioning the judgment dated 09.06.2010 rendered by the learned Single Judge in Writ Petition 2187/2005 whereby the writ petition preferred by the management challenging the judgment of the School Tribunal came to be dismissed.

The learned counsel for the appellant - management Mr. V. K. Paliwal is not present.

However, the learned counsel for the respondent 2 - employee Mr. Mohgaonkar states that Mr. Paliwal has handed over to him communication dated 18.06.2023 purportedly addressed by the

lpa515.10.O.odt employee to the management which states that the employee has superannuated and has received the entire benefit. Be that as it may, it appears that the appellant does not intend to prosecute the appeal. 4.

The letters patent appeal is dismissed.
