Shri A.M. Joshi, Additional Public Prosecutor for the respondents. CORAM : SMT. VASANTI A NAIK AND M.G. GIRATKAR, JJ.

DATE : AUGUST 09 , 2017.

By this criminal writ petition, the petitioner challenges the order of the D.I.G. (Prisons), Nagpur, dated 21.03.2017 rejecting the application of the petitioner for grant of furlough leave.

In view of the amended provisions of the Prisons (Bombay Furlough and Parole) Rules, 1959, specially Rule 4(13) thereof, we find that the D.I.G. (Prisons), Nagpur was justified in rejecting the application of the petitioner since the petitioner is convicted of the offences punishable under Sections 376 and 377 of the Penal Code.

Hence, we dismiss the writ petition with no order as to costs.
