Merely because respondent No.2-Complainant has not handed over mobile to police for investigation in alleged offences under Sections 66(a), 67, and 67(a) of Information Technology Act, that does not mean that powers under Section 482 of the Criminal Procedure Code need to be exercised. It is open to respondent No.1 to proceed in the matter in accordance with law.

However, if the applicant feels that he is being persecuted, we grant him liberty to file appropriate proceedings.

With these observations and liberty we dispose of the criminal application.
