Heard Shri S.D. Chopde, learned Counsel for the petitioner and Shri A.S. Fulzele, learned Addl.G.P. for respondent nos. 1 to 3.

We have also heard Shri V.B. Bhise, learned Counsel for intervenor. He submits that petitioner has produced a caste certificate issued by an incompetent Authority, and thereafter with a view to delay the proceedings, has not produced a certificate issued by competent Authority.

During arguments, we find that the petitioner claims to have a validity certificate in
Order 2307wp3185.18 favour of his relative [nephew]. In this situation, we keep contentions of learned counsel for intervenor open and pass the following order.

For reasons recorded in the judgment delivered on 16/07/2018 in Writ Petition No. 3143/2018 and 75 other identical matters, we quash and set aside the impugned order dated 01.02.2018, passed by the Scrutiny Committee, Akola.

The matter is restored back to the file of the said Committee with a direction to the petitioner to appear before the said Committee on 23.08.2018 at 10.30 a.m.

The petitioner to abide by the directions and the conditions stipulated in the judgment dated 16.07.2018, mentioned supra. The terms and conditions therein shall also apply to him.

Writ Petition is thus, partly allowed and disposed of. No costs.
