The appeal filed against the judgment in Summary Criminal Case No. 1866/2008 passed by the Judicial Magistrate First Class, Yavatmal which was challenged before the learned Sessions Judge, Yavatmal came to be dismissed. Against it, Criminal Revision Application No. 94/2014 was filed. The appellant had deposited Rs. 40,000/- before this Court while deciding revision finally. This Court allowed the revision and fine amount if any paid was directed to be refunded to the applicant.

In view of this direction, the present applicant claims refund of fine amount of Rs.40,000/- deposited in this Court.

In view of above, the application is allowed. 5.

The Registry is directed to refund the amount of Rs.40,000/- to the appellant.
