2] It is submitted that the petitioner is prosecuting his studies, and he is belonging to "Thakur" S.T. category. Therefore, for availing the benefit prescribed for reserved category candidates, the petitioner has submitted his caste certificate dated 31/10/2018 along with the necessary documents for verification to the college, and accordingly, the college vide application dated 27/05/2019 forwarded the tribe claim to the respondent Caste Scrutiny Committee for verification, and the same was received by the respondent Committee on 02/07/2019.
3] It is the grievance of the petitioner that despite making several applications before the
respondent Caste Scrutiny Committee for expeditiously deciding the caste claim of the petitioner, and the latest one is of dated 10/09/2020, till date the caste claim of the petitioner is not decided by the respondent Caste Scrutiny Committee. 4] It is submitted that the petitioner is studying in third year MBBS Degree Course, and immediately after completion of MBBS Degree Course, the petitioner is in need of caste validity certificate for applying to the post graduate courses from S.T. category and to take benefits enshrined for the Schedule Tribe candidate. However, the petitioner will be deprived from taking the same only due to inaction on part of the respondent Committee. Hence, it is prayed that the respondent Committee be directed to decide the caste/ tribe claim of the petitioner within the stipulated period.
5] Considering the urgency and the limited prayer made by the petitioner which is in the nature of direction to the respondent to decide the caste claim of the petitioner within stipulated period, which is pending since 27/05/2019, we direct the respondent - Committee to decide the same within a period of six months from the date the petitioner appears before the Committee in accordance with law.
6] The petitioner is directed to appear before the Committee on 07/02/2022.
7] The Writ Petition stands disposed of.
