The applicant herein has approached this Court for grant of regular bail in respect of offences registered against him as per FIR dated 19.04.2009 for offences under Sections 420, 409, 406 read with 34 of the IPC. Notice was issued in this application on 20.06.2019 on a specific contention raised on behalf of the applicant that he had undergone almost 8 years of imprisonment, which was more than maximum sentence that he could suffer for the offences alleged against him except under Section 409 of the IPC.

The learned APP has handed over a chart issued by the Superintendent, Nagpur Central Jail, showing that the applicant has remained behind bars for a period of about 7 years and 11 months already. The learned counsel for the applicant has invited attention of this Court to order dated 03.06.2019 passed in his own case by this Court granting relief on the very same ground that he has already undergone about 7 years and 11 months of imprisonment.

Hence, taking into consideration the said fact and for the reasons stated in the order dated 03.06.2019 passed in favour of the applicant in respect of another FIR, the present application is allowed and the applicant is directed to be released on bail on furnishing PR bond of Rs.50,000/- (Rs. Fifty Thousand) and a surety in the like amount and further directed that he shall remain present before the trial Court on every date of the proceedings.
