DHARMADHIKARI AND Z.A.HAQ JJ.
DATED : 31.05.2017.
Heard Shri A.V. Palshikar, A.G.P. for respondent Nos.1 and 2.
Writ petition seeks a direction that tenure of petitioner as elected Director of respondent No.3 - Urban Co-operative Bank has not come to an end. Petition is filed on 25.7.2002. This Court has on 17.8.2002 granted limited interim relief. It has been declared that if vacancy of petitioner be filled in, same would be subject to outcome of this petition. Rule was given on 30.10.2002. On that day, by mandatory order respondent No.3 - Urban Bank was asked to allow petitioner to work as Director.
Normal tenure of any elected Director of a Co-operative Society is not more than 5 years. Here that tenure is already over and petitioner has enjoyed his full tenure.
2 wp2654.02 Challenge therefore has become infructuous.
Petition is accordingly dismissed as infructuous. Rule discharged. No costs.
JUDGE JUDGE Tambaskar.
