The grievance of the petitioner is that the order dated 29.11.2016 passed in Writ Petition No.5732/2004 by which the Nagpur Improvement Trust-the respondent no.1 was directed to provide Transferable Development Rights (TDR) in accordance with Development Control Regulations of 2000 to the petitioner. After the writ petition was decided various communications dated 28.02.2019, 06.08.2019 and 08.11.2019 have been issued to the petitioner to supply requisite documents to facilitate grant of TDR. Similarly on 12.12.2019, the petitioner was informed about the requirement of necessary documents in that regard. It appears that despite being informed about the documents required, the petitioner till date has not supplied the same to the office of the respondent no.1 as a result of which the directions issued in the writ petition could not be carried further. We have been shown the order sheets as well as various notices issued to the petitioner on the dates mentioned above to supply

911.CP202.19.odt 2 the said documents. It appears that despite sufficient notice to the petitioner, he is not interested in supplying the documents as demanded.

In that view of the matter, we do not find any deliberate breach of the directions issued in Writ Petition No.5732/2004 by the respondents. The contempt petition is therefore disposed of.

Needless to state that it is open for the petitioner to take all necessary steps in pursuance of the order passed in Writ Petition No.5732/2004 in accordance with law. JUDGE JUDGE Andurkar..
