The dispute is in between husband and wife.

Due to matrimonial discord wife has lodged the report against the husband. After considering prima facie material, this Court has granted interim protection to the husband. During the pendency of this application, it is stated that the custody of husband is needed only to recover a document of "Qubulnama".

Learned Additional Public Prosecutor upon instructions from the investigating officer made a statement that as per directions, the concerned document is handed over by the applicant to the police and now they do not require his custody. 4.

Having regard to the nature of accusation and above facts, the applicant's liberty can be protected by putting some conditions. In view of that following

(a) Application stands allowed.

(b) Ad-interim order dated 08/09/2021 is hereby made absolute upon same terms and conditions. (c) Henceforth, the applicant shall attend concerned police station as and when called.

(d) The applicant/accused shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also shall not tamper with the evidence.
