DATED : JANUARY 15, 2018 Writ Petition No. 2776/2002 was disposed of by judgment dated 4/10/2017. The amount in deposit (Rs.1,04,563/-) was directed to be dealt with in a particular manner as stipulated in para 22 thereof. 2) Shri Haque, learned Counsel for petitioner, has filed a pursis dated 21/11/2017 and pointed out that that amount has not been deposited at all by respondent no.4 Municipal Council.
3) Issue notice before admission as to why action for contempt should not be taken against respondent no.4 Municipal Council. Notice is made returnable on 2/2/2018. On that day, Chief Officer of Municipal Council shall remain present with necessary cheque.
1501wp2776.02 2/2 4) Registry to note that this is the second such matter in which Court orders are shown to be ignored by the Registry. In earlier matter, the concerned person has still not deposited the amount.
5) Registrar (Judicial) to conduct enquiry in this respect within one week and submit preliminary report before this Court for its perusal indicating therein the persons against whom action needs to be taken. The fact that such Officer/staff member of this Court has retired will be ignored while preparing the report. 6) List on 2/2/2018.
