ATED : 14th January, 2021 The applicant has filed the present Application u/s 439 of the Cr.P.C. seeking bail for offence punishable under sections 376 (2)(n), 500, 506, 34 of the Indian Penal Code read with section 6 and 12 of the Prevention of Children from Sexual Offences Act, 2012 registered at Police Station, Mahagaon, Dist. Yavatmal in respect of Crime No. 386/2017.

I have heard learned counsel for the respective parties. Perused the papers.

It is alleged that the applicant and the victim were having love-affairs and although the applicant promised to marry with the victim, he refused to do so and, therefore, the complaint. Considering the nature of the offence and the allegations against the applicant, in my opinion, he is entitled for the relief.

ORDER

The applicant - Onkar Arun Narwade, be released on bail for the offence punishable under sections 376 (2)(n), 500, 506, 34 of the Indian Penal Code read with section 6 and 12 of the Prevention of Children from Sexual Offences Act, 2012 registered at Police Station Mahagaon, Dist. Yavatmal in respect of Crime No.386/2017, on his executing a PR bond in the sum of Rs.25,000/- (rupees twenty five thousand) with one solvent surety in the like amount, on the following conditions :- (i) The applicant shall attend Police Station, Mahagaon, Dist. Yavatmal, on once in a week ( i.e. every Monday) between 11.00 am to 2,.00 pm, till the culmination of the trial. (ii) The applicant shall not tamper with the prosecution witnesses in any manner.

(iii) The applicant shall provide his residential address and cellphone number to the concerned Investigating officer and he shall not change the same without prior intimation to the Investigating Officer.

(v) Breach of either of these conditions will entitle the State Government to move for cancellation of bail.

Criminal Application stands disposed of.
