Nobody appears for the petitioners.

The prayer is to declare that the provisions of the Maharashtra Rice (Levy on Rice Millers) Order, 1989 do not apply to the petitioners.

The learned Assistant Government Pleader has invited attention of this Court to the reply-affidavit. He points out that the petition has been filed with a grievance that the petitioners are not "Licensed Millers" as defined in Section 2 (g) of the said enactment. He submits that vide amending Act vide notification dated 24.6.1998 the words "Licensed Millers" in 1989 Order have been replaced by word "Miller". Writ Petition is filed on 30.6.1998. According to him, thus the very foundation of the petition is lacking.

Copy of the reply has been served upon the petitioners on 29.7.2000 and thereafter there is no counter. In this situation, we find no merit in the petition. It is accordingly dismissed. Rule is discharged. No costs. JUDGE JUDGE Wadkar
