Prayer is to condone the delay in filing first appeal. It is stated that applicant was relying upon the advise given by officers of the Insurance Company. It is also stated that applicant was under medical treatment as per the medical certificate annexed. The application is opposed by respondent nos. 1 to 4 on the ground that reasons assigned are false and applicant was aware about pendency of the proceedings. Reply is also filed by respondent no.6 opposing the prayer for condonation of delay. Considering the reasons assigned in the application and the fact that applicant has been held liable to pay compensation, the delay is condoned subject to costs of Rs. 3000/- to be paid by the applicant to non applicant nos. 1 to 4 within a period of 4 weeks from today. Civil application is allowed and disposed of.
