The order passed by the Additional Commissioner, Nagpur dated 22/04/2014 deserves to be set aside only on the ground that there are no reasons whatsoever assigned in the impugned order. Except reproducing the contentions raised by the appellant, there is no adjudication of those contentions and the appeal has been dismissed. Hence without going into merits of the matter, by setting aside order dated 22/04/2014 the proceedings are remitted to the Additional Commissioner, Nagpur for fresh decision after giving opportunity to the parties.

The parties shall appear before the Additional Commissioner on 20/07/2015 to enable the Additional Commissioner to hear and decide the appeal on merits. The appeal shall be

Petition is allowed in aforesaid terms with no order as to costs.
