By this present application, the applicant/appellant is seeking early hearing of the appeal on the ground that the appellant is of 70 years old.

The record shows that earlier application for early hearing was granted, but when the matter listed thrice for final hearing, the counsel for appellant remained absent. Considering this fact, the application out to have been rejected. However, considering the age of the appellant, just because of mistake of lawyer, the appellant should not be affected. The civil application is allowed and disposed of accordingly.
