Heard.
The applicant is arrested on 25th August, 2016 in crime registered against him for the offences punishable under Sections 302, 307 and 498-A of the Indian Penal Code, on the accusation that he has set ablaze his wife. According to the Investigating Agency, there was some quarrel between the applicant and deceased (wife of applicant), the applicant was under influence of alcohol, applicant in the hit of anger instigated her to pour kerosene on her person which deceased did and the applicant set her ablaze.
The investigation is complete and charge-sheet is filed on 16.11.2016. The applicant claims to be agricultural labourer and has stated that he is not involved in any other crime/offence. The non-applicant has not been able to show that the custody of applicant is required for further investigation.
2 ba539.17 Considering the facts of the case, the following order is passed :
The applicant having been arrested in Crime No.298 of 2016 registered by the non-applicant, he be released on bail on executing P. R. Bond of Rs.50,000/- and furnishing two solvent sureties for Rs.25,000/- each. The applicant shall regularly attend the trial before the Sessions Court unless granted exemption by the Sessions Court.
