DATE : April 02, 2018 After hearing the learned counsel for the parties for sometime, Shri S. S. Alaspurkar, learned counsel for the respondent, on instructions, submits that the prayer with regard to payment of permitted increases as made in the application at Exhibit-31 is not sought to be pressed. He states that said application be treated as praying for direction to deposit the rent along with municipal taxes and water charges.

In view of this submission, the application at Exhibit-31 is treated to be an application only for directions to deposit the rent with municipal taxes and water charges. In view thereof the interim order dated 10/02/2017 and specially direction No.4 shall operate only with regard to payment of monthly rent from 01/01/2011. The direction to pay permitted increases from 14/01/2006 onwards shall stand deleted.

26-WP-4140-17 2/2 The respondent is at liberty to take appropriate steps to claim permitted increases in accordance with law.

In the circumstances proceedings in R.C.S.No.824/2012 are expedited. The suit be decided by the end of December 2018.

The Writ Petition is partly allowed in aforesaid terms and disposed of. No costs.
