The State has challenged the common judgment of the Reference Court dated 25.01.2008. It is to be noted that the adjudication in L.A.C. No.6 of 2003 was challenged in First Appeal No.323 of 2009 and this Court by judgment dated 31.10.2018 after considering the evidence on record has upheld the said common judgment of the Reference Court and dismissed the appeal. In the light of the fact that this appeal arises from that common judgment and the adjudication in L.A.C. No.6 of 2003 has been accepted, for reasons assigned in the judgment dated 31.10.2018 in First Appeal No.323 of 2009, this appeal also stands dismissed. The judgment of the Reference Court is confirmed. The respondent is at liberty to withdraw the amount of compensation alongwith accrued interest.
