Heard.

The applicant, apprehending arrest in crime registered against him for the offences punishable under Sections 326, 506 read with Section 34 of the Indian Penal Code, has sought pre-arrest bail. The accusations against the applicant are that on the date of incident quarrel triggered off between the applicant and the complainant because of some old dispute and the applicant gave blow of stick on the head of the complainant.

The applicant, aged about 21 years, claims to be a student. The applicant has stated that he is not involved in any other crime/ offence. These facts are not controverted by the non-applicant in the reply filed by it before the Sessions Court, the copy of which is placed on record at page No.19. Considering the facts of the case and nature of the accusations against the applicant, in my view, the applicant is entitled for protection.

In the event of arrest in Crime No. 438/2017, registered by the non-applicant, the applicant be released on bail on executing P.R. Bond for Rs.Ten Thousand. The application is allowed in the above terms. JUDGE RRaut..
