It is not in dispute that the role performed by this applicant is limited to the extent of his standing as guarantor for securing repayment of the loan. The documents of the properties mortgaged by him as a security for repayment of loan have been admittedly found to be genuine and clear. There is no other allegation made against this applicant indicating that he also was a part of the alleged dishonest design to cheat the Bank. In the circumstances, I am of the view that this applicant is entitled to be released on anticipatory bail. Hence, the order. The application is allowed and the interim bail granted to the applicant by this Court on 30/6/2016 is hereby confirmed on the same conditions except the condition regarding his attendance and that now the applicant shall attend the police station as and when required.
