Heard Shri N.S. Warulkar, learned counsel for the applicants - respondent Nos. 4 & 5, Shri P.B. Patil, learned counsel for the petitioner and Shri S.M. Ukey, learned Additional GP for respondent Nos. 1 to 3. 2.

Respective counsel submit that orally this Court has observed that the order dated 15.06.2017 need not be acted upon and application for recalling will be looked into when writ petition would be heard for admission. 3.

As this position is not in dispute between the parties, we find that Civil Application (W) No. 1279 of 2017 or for that purpose, the order dated 15.06.2017 cannot come in the way of admission of writ petition. Hence, with direction to respondent Nos. 4 & 5 to remain present at the time of admission of the petition, we recall the direction issued to them on 15.06.2017.

Civil Application is disposed of. No costs. List writ petition for admission on 08.01.2018.
