Mr. N.S.Khubalkar, the learned Assistant Government Pleader for the respondent nos. 1 and 2 raises a preliminary objection as regards tenability of the Writ Petition, on the ground that the petitioner has an alternate, efficacious remedy of filing an Original Application, before the Maharashtra Administrative Tribunal. It is stated that instead of availing the alternate remedy, the petitioner has rushed to this Court.

By upholding the preliminary objection raised on behalf of the respondents 1 and 2, we dispose of the Writ Petition, with no order as to costs. The points raised in the Petition are, however, kept open.
