CRIMINAL APPLICATION No. 124 OF 2020 (APPR) Heard learned counsel for the applicant.

This is an application seeking suspension of sentence and grant of bail. The learned counsel informs this Court that the applicant was taken into custody on the date of the judgment of the Appellate Court and that presently he is in jail. A request was made for
2 / 2 01-REVN 118.2020 suspending the sentence and to grant of bail to the applicant. It was further submitted that the applicant would abide by the conditions that may be imposed by this Court.

The two Courts below have concurrently found the applicant guilty of offences under Section 354A(1)(ii) and 354D(1)(i) of the Indian Penal Code. Considering the nature of offences for which the applicant has been found guilty by the two Courts below, this Court is of the opinion that the present application can be allowed subject to specific conditions. It is submitted on behalf of the applicant that fine amount is already deposited by the applicant.

In view of the above, the present application is allowed.

The sentence is suspended and the applicant is directed to be released on bail subject to furnishing P. R. bond of Rs.15000/- (Rs. Fifteen Thousand only) and surety in the like amount and on the further condition that the applicant shall not enter the locality where the complainant resides.

Application is disposed of.
