2 wp3241.18 CORAM : B.P. DHARMADHIKARI AND Z.A.HAQ, JJ. DATED : 15.6.2018.

1.

In writ Petition Nos.3225/2018, 3226/2018, 3227/2018 and 3164/2018 Advocate N.A. Gaikwad waives notice for respondent No.4 - Admission Regulatory Authority. In Writ Petition No.3241/2018 Advocate Abhijeet Deshpande has appeared for respondent No.5.

2.

It is not in dispute that after orders of this Court in Writ Petition No.3241/2018 ad 3264/2018 and other connected matters the Government of Maharashtra through its Common Entrance Test Cell has on 13.6.2018 issued a notice and permitted students who have passed S.S.C. or equivalent examination from institutions outside State of Maharashtra subject to their fulfilling the other conditions imposed in the amendment of which this Court has taken note.

3.

Notice dated 13.6.2018 is taken on record as Exhibit "X". Parties states because of this notice challenge in writ petitions does not survive. 4.

However, we find that in notice the eligibility

3 wp3241.18 has been conferred upon students subject to final decision of petitions before this Court. Learned A.G.P., upon instructions, expressly states that the State Government through its Common Entrance Test Cell is not opposing the petitions at all. He submits that petitions are pending before this Court and by way of abundant precaution clarification has been introduced in the notice.

5.

In view of this submission made by learned A.G.P, we find that petitioners and other similarly situated students are being considered as eligible by said Common Entrance Test Cell. Hence, their grievance does not survive.

6.

Accordingly, we dispose of writ petitions.

JUDGE JUDGE Tambaskar.
