Mr. M. J. Khan, A.P.P.for applicant-State.

Mr. M. P. Khajanchi, Advocate for non applicants. CORAM : V. M. DESHPANDE, J.

DATED : JANUARY 22, 2020 This is an application for condonation of delay in preferring the appeal challenging the judgment and order of acquittal passed by learned Sessions Judge, Chandrapur in Special Case No.19/2004, whereby non applicant no.1 who is Tahsildar and non applicant no.2, who is clerk were acquitted of the offence punishable under Sections 7 read with Section 12 and 13 (1) (d) read with Section 13 (2) of the Prevention of Corruption Act.

The application is vehemently opposed by Mr.Khajanchi, learned counsel for non applicants. After hearing learned A.P.P. for applicant and after perusing application for condonation of delay, I am of the opinion that State has explained the delay of 123 days. In that view of the matter, the application is allowed. The delay stands condoned.

The application is disposed of.
