This is an application moved on behalf of the respondent (wife) for withdrawal of amount of Rs.35,250/- deposited by the non-applicant/petitioner (husband) in this Court. While issuing notice, this Court had directed the petitioner to deposit 50% of the arrears and the amount of Rs.35,250/- pertains to the same, but, later this Court had directed the petitioner to deposit the entire arrears, failing which the petition would stand dismissed without reference to the Court. As the petitioner failed to deposit the entire amount of arrears, the writ petition stood dismissed as per the aforesaid conditional order. But, the said amount of Rs.35,250/- is still lying in this Court. Hence, this application.
For the reasons stated in the application, the same is allowed and the applicant-respondent (wife) is permitted to withdraw the said amount of Rs.35,250/- lying in deposit in this Court. The application stands disposed accordingly. JUDGE APTE
