The learned counsel for the petitioner has tendered an application for grant of permission to withdraw the writ petition with liberty to file an application in Writ Petition No.1347/2001 in the court today. The same is accepted on record.

It is stated on behalf of the petitioner that in view of the orders passed by the School Tribunal in more than a couple of matters between the same parties, it would be necessary in the interest of justice to grant liberty to the petitioner to file an application in Writ Petition No.1347/2001, decided on 3.4.2009.

Shri Vyas, the learned counsel for the respondentmanagement, does not have any objection against granting of the prayer made in the Civil application.

Hence, we permit the petitioner to withdraw the writ petition with liberty to file an application in Writ Petition No.1347/2001, decided on 3.4.2009.

The writ petition is disposed of, as withdrawn, with liberty as prayed for.

In view of the apprehension expressed by the learned

2 wp4433.14.odt counsel for the respondent-management, it is needless to mention that the application that may be filed by the petitioner in the disposed of writ petition would be considered along with the objections of the respondent-management, to the same.
